Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RestaurantManage platform and its products (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms incorporate by reference our Privacy Policy and Cookie Policy.
1. Operator
The Service is operated under the RestaurantManage brand by Utku Berberoğlu, a natural person established in the Republic of Türkiye ("we", "our", "us"). Contact: info@restaurantmanage.com, +90 541 162 23 83.
2. The Service
RestaurantManage is a software platform that provides QR menus, order management, kitchen/cashier panels, table and delivery management, reporting, and related restaurant operations tools. The Service is provided on an "as available" basis and may evolve over time.
3. Accounts and Eligibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. You must be legally capable of entering into a binding contract to use the Service.
4. Acceptable Use
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable law;
- attempt to gain unauthorized access to the Service, other accounts, or our systems;
- interfere with or disrupt the integrity or performance of the Service;
- upload content that infringes third-party rights or is unlawful, misleading, or harmful;
- reverse engineer or resell the Service except as permitted by law.
5. No Fiscal Device — Important
The Service is NOT a cash register, point-of-sale fiscal device, electronic fiscal unit (ÖKC/yeni nesil yazarkasa), or an issuer of official fiscal receipts or invoices. Order slips and receipts generated by the Service are operational documents only; where applicable they carry a "no monetary value" ("MADDİ DEĞERİ YOKTUR") notice and do not constitute, and must not be used in place of, a legally mandated fiscal receipt or invoice.
The Service does not process payments. Amounts displayed and "paid" statuses recorded in the Service are for operational tracking only; the actual collection of payment occurs outside the Service (e.g., at the restaurant's own till or terminal). Each restaurant ("Subscriber") is solely and exclusively responsible for issuing legally compliant fiscal documents through its own approved device and for fulfilling all of its tax, accounting, and regulatory reporting obligations. We assume no responsibility for the Subscriber's compliance with tax or fiscal-document legislation.
6. Subscriptions, Fees, and Payment
Certain features are offered free of charge; others may require a paid subscription. Where a paid plan applies, the price, billing period, and included features will be presented to you before purchase. Unless stated otherwise, fees are exclusive of applicable taxes. Subscriptions renew for successive periods unless cancelled before the renewal date. We may change pricing prospectively with reasonable prior notice; changes do not affect the period already paid for.
7. Cancellation and Withdrawal (Distance Sales)
You may cancel a paid subscription at any time; cancellation takes effect at the end of the then-current billing period and stops future renewals. To the extent the Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği) or equivalent consumer-protection law applies, statutory withdrawal and refund rights are preserved. Except where required by law, fees already paid for a commenced billing period are non-refundable. To cancel or request a refund, contact info@restaurantmanage.com.
8. Intellectual Property
The Service, including its software, design, and trademarks, is owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. Content you upload remains yours; you grant us the rights necessary to operate and provide the Service.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our aggregate liability for any claim shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim.
11. Suspension and Termination
We may suspend or terminate your access if you breach these Terms or if required to protect the Service or comply with law. You may stop using the Service and delete your account at any time as described in our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by updating the "Last Updated" date and, where appropriate, by additional notice. Continued use after changes take effect constitutes acceptance.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws rules. The courts and enforcement offices of İstanbul, Türkiye shall have jurisdiction, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
